How would I know if my child’s Cerebral Palsy was due to an avoidable medical mistake?
Before contacting an attorney…
Children are innocent and need our protection. For they can do nothing but rely on the adults who must care for them. As a parent or guardian, let us try and help you, as we have helped thousands of other families, and find out if your child’s condition could have been avoided. Unfortunately, this is not an easy question to answer. Past case results do not guarantee or predict a similar result in future cases, and are always dependant upon the facts of each case.
It takes a series of complex steps to determine what exactly caused your child’s Cerebral Palsy, Erbs Palsy, or other neurological condition.
Ultimately, an affiliated, professional team of medical and legal experts will need to investigate on your behalf and decide what, if anything, could have prevented your child’s condition.
However, there is something you can do right now to begin exploring what really happened. Simply take a few minutes and ask yourself the following questions:
- Did my baby suffer injuries before, during, or after birth?
- Did the medical staff fail to order and/or interpret any specific tests during my pregnancy and/or labor?
- Did the medical staff fail to diagnose any changes in my baby’s heartbeat during pregnancy?
- Did the medical staff fail to diagnose any changes in my baby’s heartbeat during delivery?
- Did the medical staff fail to perform an emergency C-section when they knew my baby or I was in distress?
- Did the medical staff fail to deliver my baby in a safe and timely manner after I was in labor too long?
- Did I develop an infection (urinary tract infection (UTI), German Measles, Rubella or Toxoplasmosis) while pregnant?
- Did my doctor tell me not to worry about my infection and withhold medication or delay in prescribing some to me?
- Was I tested for Rh incompatibility?
- Did the doctor deliver my baby with forceps or a vacuum extractor?
- Did my baby get stuck in the birth canal for too long?
- Did my placenta rupture or become inflamed?
- Did I have preeclampsia/hypertension that was not dealt with quickly and professionally?
- Was my baby delivered more than 24 hours after my water broke?
- Did I have a fever that was 100.4 F or higher that my doctor didn’t take seriously?
- Did the doctor fail to try and stop my early delivery?
- Did my baby have jaundice?
If you answered “Yes” to even ONE of these questions, it is possible that a medical legal expert would conclude that your child did not have to experience Cerebral Palsy, or any other neurological complication. What you need to do now is take one more step.
Contact us for information about Benefits4Life, and we can assist you with an affiliated medical legal expert, and determine if your doctor and medical team did everything they could have to keep you and your baby safe.
